The terms used in this Impartiality Statement (hereinafter referred to as the “Statement”), specified by Asesoría Empresarial y Humana, S.C. (hereinafter referred to interchangeably as “ASEMHLAB”, “LABORATORIO”, “ASEMH”, “our”, or “we”), encompass the most important points regarding impartiality.
ASEMHLAB recognizes the importance of providing its testing and analysis services as an Authorized Third-Party Laboratory, ensuring complete impartiality and independence. Therefore, its objective is to guarantee the maintenance of this impartiality and independence at all levels of the organization.
ASEMHLAB declares:
- It is not a manufacturer, distributor, marketer, purchaser, owner, or user, nor is it involved in any of the aforementioned activities that could create a relationship with the testing and analysis services that might conflict with its independence of judgment and integrity in performing said services.
- This Declaration applies in a non-discriminatory manner to all parties involved in or interested in the services provided by ASEMHLAB.
To avoid conflicts of interest, the Laboratory's Technical Staff will be free from any commercial, financial, or other pressure that could influence their judgment. To this end, the following controls have been established:
- No holding shares in the companies and/or organizations that contract the testing and analysis services provided by ASEMHLAB, nor working for or receiving remuneration from them.
- No accepting or soliciting personal benefits that, by their nature or value, could influence or appear to influence the judgment of the individual when performing their duties.
- The remuneration of technical staff is not linked to the number of analyses performed, nor, in any case, to the results of such analyses.
- New staff members joining the technical team will sign a confidentiality agreement prior to signing their contract.
- Recognizing the importance of ensuring that ASEMHLAB's management has no commercial interests in the items for which services are contracted, ASEMHLAB requires its directors to declare any other economic or financial activity directly related to the services provided by ASEMHLAB.
Likewise, ASEMHLAB staff have committed to complying with a Code of Confidentiality, Impartiality, and Integrity, summarized as follows:
- Do not yield to client pressure to obtain favorable treatment.
- Do not accept a position or employment with a competitor or client company, except as a result of performing their duties at ASEMHLAB.
- Not to hold any stake in a supplier, client, or competitor of ASEMHLAB, except for publicly traded securities, and provided that such stake is not significantly influenced or creates undue dependence.
- Not to accept an office or employment outside of ASEMHLAB without prior authorization.
- Not to accept any personal benefit for oneself, relatives, or friends that could influence or appear to influence one's judgment or actions while performing duties for ASEMHLAB.
- Not to derive personal advantage from ASEMHLAB's business opportunities, nor to use ASEMHLAB's property or resources for personal purposes.
- Refrain from disclosing any confidential information acquired in the course of one's duties.
Furthermore, ASEMHLAB undertakes not to issue any documentation or advertising material or conduct any sales presentations that link or compromise the results of client analyses, in particular, to the services provided.
ASEMHLAB is a Third-Party Authorized Laboratory authorized by the Federal Commission for Protection against Sanitary Risks (COFEPRIS) to support the authority in sanitary control and surveillance by performing analytical testing.
